1. General Provisions

These Terms and Conditions regulate the sale of products through https://canvartin.com and define the legal relationship between the Seller and the Customer.

The Seller operates independently, without intermediaries or third-party vendors. All products are designed, produced, and shipped directly by us.

By placing an order on this website, you confirm that you are at least 18 years old or have parental permission to make a purchase.

We reserve the right to modify these Terms and Conditions at any time, particularly in response to changes in legislation, regulatory requirements, or website functionality. Any changes will be communicated on the website and remain visible for 10 days from publication.

• Customer: Any individual purchasing products through this website.
• Consumer: An individual making a purchase for personal use, not for business or resale purposes.
• Professional Buyer: A business or legal entity purchasing for commercial purposes.
• Products: Wall art, including canvas prints, framed prints, and posters.
• Order: A legally binding request to purchase products through the website.

3. Products and Availability

We offer premium-quality wall art that is pre-designed and ready for immediate production. Our products include:

• Canvas prints (stretched on solid wooden frames).
• Framed wall art in various sizes and finishes.
• Posters printed on premium paper.

All images on the website are for illustrative purposes. Slight variations in color and texture may occur due to screen differences and the nature of printing.

Customers purchasing framed prints can choose from available frame colors. Once an order is placed, it cannot be changed or canceled if the product has already entered the production phase.

The Seller reserves the right to modify the range of Products available on the Website at any time. If a Product becomes unavailable after an order is placed, the Customer will be notified as soon as possible and given the option to choose an alternative Product or receive a full refund.

4. Prices and Payment

All prices on the Website are displayed in euros (€) and include applicable VAT. The final price displayed at checkout includes:

• The cost of the selected Products.
• Any applicable shipping fees (if relevant).

The Seller reserves the right to modify prices at any time. However, the price applied to the Customer's purchase is the one displayed at the moment of placing the Order.

Accepted payment methods:

• PayPal: Secure transactions with buyer protection.
• Credit/Debit Cards: Visa, MasterCard, American Express.
• Bank Transfers: Orders will be processed once the payment is received.

By completing a purchase, the Customer confirms that they have the legal right to use the selected payment method. The Seller reserves the right to cancel Orders if fraudulent payment activity is suspected.

5. Order Processing and Production

Each Product is made on demand and undergoes a careful production process. The average production time is:

• Canvas Prints & Posters: 2-5 business days.
• Framed Prints: 3-7 business days.

Orders are processed as soon as payment is confirmed. The Customer receives an order confirmation via email. Once production has started, the Order cannot be modified or canceled.

During peak seasons, such as holidays or sales events, production times may be extended. Customers will be notified of any significant delays.

6. Shipping and Delivery

Free shipping is available for orders that meet or exceed the minimum order value specified on the product page. Estimated delivery times:

• Spain: 3-5 business days.
• EU Countries: 5-8 business days.
• Worldwide: 8-15 business days.

Customers will receive a tracking number via email once their order has been shipped.

6.1 Shipping Partners

To ensure reliable and efficient delivery, we work with the following carriers:

• Correos España - For domestic and international shipping.
• Packlink PRO - For optimized shipping solutions across Europe.
• InPost.es - For parcel locker delivery options.

6.2 Customs & Import Duties

For deliveries outside the European Union, import duties and customs fees may apply. These fees are determined by the local customs authorities of the destination country.

The Customer is responsible for any customs charges incurred. The Seller does not cover customs fees, and failure to pay them may result in delays or order cancellation.

6.3 Delivery Issues

In rare cases, shipments may be delayed due to external factors, such as weather conditions, strikes, or customs delays. The Seller is not responsible for delays caused by third parties but will assist Customers in tracking their orders.

Upon delivery, the Customer is responsible for checking the package for any visible damages. If damage is found, the Customer should refuse the package or note the issue on the courier's delivery form before signing.

For missing or delayed packages, the Customer should contact the Seller at admin@canvartin.com as soon as possible.

7. Returns & Right of Withdrawal

The Customer has the right to return a product under Spanish Consumer Law (Real Decreto Legislativo 1/2007) and the EU Consumer Rights Directive 2011/83/EU.

7.1 14-Day Right of Withdrawal (Returns Without Justification)

Customers within the European Union have the right to withdraw from their purchase within 14 days of receiving the product, without providing a reason.

To exercise this right:

• The Customer must notify the Seller by email at admin@canvartin.com.
• The product must be unused, undamaged, and in its original packaging.
• Return shipping costs are covered by the Customer.

Upon receiving and inspecting the returned item, the Seller will process a refund within 14 days to the original payment method.

7.2 Defective or Damaged Products

If the Customer receives a damaged or defective product, they must contact the Seller within 48 hours of delivery.

The Customer must provide photo or video evidence of the defect to qualify for:

• A free replacement of the product.
• A full refund, if the product is no longer available.

7.3 Non-Returnable Items

Certain products cannot be returned, including:

• Customized or personalized products (except in cases of damage or defects).
• Products that have been used or show signs of wear.
• Items returned without prior notification to the Seller.

8. Refunds

Refunds are processed within 14 days of receiving the returned product. Refunds will be issued to the original payment method.

If the refund is delayed, the Customer should contact their bank or payment provider, as processing times may vary.

9. Lost or Undelivered Shipments

In the event of a lost package, the Seller will send a free replacement if:

• The courier confirms that the package was lost.
• The Customer provides their correct shipping details.

If the Customer provided an incorrect shipping address and the package cannot be delivered, the order will not be refunded.

10. Product Warranty

All products are covered under Directive (EU) 2019/771 on Contracts for the Sale of Goods, which grants Customers a two-year warranty on defects.

The warranty does not cover:

• Damage caused by improper use.
• Normal wear and tear.
• Modifications made by the Customer.

11. Force Majeure

The Seller is not liable for failure to fulfill obligations due to force majeure events, including:

• Natural disasters.
• War, riots, or civil disturbances.
• Government actions or regulations.
• Strikes or labor disputes affecting production or delivery.

12. Intellectual Property

All content on the Website, including images, text, and product designs, is the exclusive property of Canvartin. Unauthorized reproduction or distribution is strictly prohibited.

13. Data Protection and Privacy

We process Customer data in compliance with GDPR (Regulation (EU) 2016/679) and Spanish Data Protection Law (Ley Orgánica 3/2018).

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by Spanish law. Any disputes will be settled in the courts of Málaga, Spain.

17. Promotions and Special Offers

1. Buy 2, Get the Third Free: In "Buy 2, Get the Third Free" promotions, the free product will always be the item with the lowest price among the selected products in the same order. The promotion applies to the product of lesser value.
2. Right to Change Promotion Terms: We reserve the right to amend, modify, or discontinue the terms and conditions of any promotion at any time, without prior notice. However, such changes will not affect orders that have already been placed and confirmed by the customer prior to the change. All orders placed before any modification will be honored under the original terms of the promotion.
3. Order Reservation and Fulfillment: Once an order is placed, reservation and processing begin immediately during business hours. We promptly send orders to production and printing to ensure timely fulfillment. Please note that changes or cancellations may not be possible after the order is submitted for production.

18. Business (B2B) Customers

The consumer protections described in Section 7 (Returns & Right of Withdrawal), Section 10 (Product Warranty), and the Return & Refund Policy are granted to Consumers as defined by EU law — natural persons acting for purposes outside their trade, business, craft, or profession (Article 2(1) of Directive 2011/83/EU).

If you purchase as a business, sole trader, or other professional entity ("Professional Buyer"), the following applies instead:

• No statutory right of withdrawal: the 14-day right of withdrawal under Directive 2011/83/EU is a consumer-only right and does not apply to Professional Buyers. Any right to cancel or return an order is at the Seller's discretion and must be agreed in writing.
• Commercial warranty terms: the statutory two-year conformity guarantee under Directive (EU) 2019/771 applies to consumer sales. For Professional Buyers, warranty terms are governed by the general provisions of the Spanish Civil Code and Commercial Code, and any specific terms agreed at the time of order.
• Invoicing and VAT: Professional Buyers must provide a valid company name, registered address, and VAT/Tax Identification Number when placing an order. For intra-EU business purchases with a valid VAT number, the reverse-charge mechanism may apply in accordance with Council Directive 2006/112/EC.
• Dispute resolution: the EU Online Dispute Resolution (ODR) platform referenced in Section 15 is available to consumers only. Disputes with Professional Buyers are subject to the courts of Málaga, Spain, as set out in Section 14.

By placing an order and confirming that you are purchasing on behalf of a business, you agree that the Professional Buyer terms in this Section apply to your order.
